1Acceptance of Terms

By accessing or using Scoutlify (the “Service”) you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use the Service.

You must be at least 18 years old to create an account. If you are using the Service on behalf of a company, firm, or organization, you represent that you have authority to bind that entity to these Terms.

2Description of the Service

Scoutlify is an online marketplace that connects buyers and renters with licensed real-estate brokers and agents across the Philippines. The Service includes:

• Listing creation, search, and discovery for properties for sale or rent.
• Direct messaging between inquirers and listing brokers.
• Subscription tools for brokers — analytics, lead scoring, CRM, blog publishing, and promoted listings.
• Optional payment processing for broker subscriptions via PayMongo.

Scoutlify does not own, manage, sell, lease, or appraise any property. We are a venue for brokers and consumers to find each other; the actual transaction is between you and the broker.

3Accounts & Eligibility

To list properties, message brokers, save favorites, or subscribe to a paid plan you must create an account. You are responsible for:

• Keeping your login credentials confidential.
• All activity under your account — including charges processed against your saved payment method.
• Notifying us immediately of any unauthorized access via support@scoutlify.com.

We may verify the identity, license status, and business registration of broker accounts at any time. Misrepresentation of credentials is grounds for immediate suspension.

4User Roles & Responsibilities

Inquirers (buyers / renters)

You may browse listings, save favorites, contact brokers, and schedule property visits. You agree that any decision to buy, rent, or visit a property is your own — Scoutlify does not warrant the accuracy of any listing.

Brokers / agents

You may create and manage property listings, respond to inquiries, publish blog content, and run promotions. You represent and warrant that:

• You hold a valid PRC real-estate license (or are operating under one as an agent/sales-person of a licensed brokerage), as applicable to your jurisdiction.
• You have the right to list each property you publish.
• Every listing contains accurate, non-misleading information about price, location, status, and ownership.
• You will respond to inquirer messages in good faith and within a reasonable time.

Administrators

Scoutlify staff with admin privileges may review and moderate listings, messages, accounts, and payments to enforce these Terms.

5Acceptable Use

You agree NOT to:

• Post listings for properties you don't own or aren't authorized to represent.
• Misrepresent prices, square footage, ownership status, or location.
• Solicit users to transact outside the Service for the purpose of evading our fees.
• Send unsolicited promotional messages, spam, or chain communications.
• Upload malicious files, viruses, or content designed to disrupt the Service.
• Attempt to access another user's account, scrape the Service at scale, or circumvent security controls.
• Use the Service for any unlawful purpose, including money laundering, fraud, or facilitating discrimination prohibited by the Fair Housing provisions of applicable law.
• Impersonate another person, broker, or organization.

Violation of these rules may result in content removal, account suspension, termination, and where applicable, referral to law enforcement.

6Listings & Content Ownership

You retain ownership of the content you upload (listings, photos, descriptions, blog posts, profile information). By uploading content, you grant Scoutlify a worldwide, royalty-free, non-exclusive license to host, display, reproduce, distribute, and create derivative works of that content for the limited purposes of operating, marketing, and improving the Service.

This license ends when you delete the content, except where:

• The content has been shared with other users (e.g. an inquirer received your message) and they retain their own copy.
• We are required to retain the content for legal, audit, or backup reasons (anonymized where feasible).

You confirm that every piece of content you upload either belongs to you or you have the necessary rights and licenses to publish it.

7Broker Subscriptions & Billing

Some features are gated to paid subscription tiers — currently Solo (free), Portfolio, Broker Pro, and Agency. See /pricing for the current prices and included features.

Auto-renewal

Paid plans are billed in 30-day periods and renew automatically. You can cancel at any time from Broker → Billing; cancellation takes effect at the end of the current period.

Failed payments

If a charge fails, your subscription enters a Past due state. We will retry the charge over the next few days. If the issue isn't resolved within 7 days, paid features will be disabled and the account will downgrade to Solo.

Currency & taxes

All prices are in Philippine Pesos (PHP) and are inclusive of applicable taxes unless otherwise noted. Payment processing is performed by PayMongo, a licensed payment institution; their terms also apply to the payment transaction.

8Refunds & Cancellations

Our refund policy — including the 7-day money-back window for new subscriptions, eligible refund reasons, processing times, and non-refundable charges — is documented separately at /refund-policy. That document forms part of these Terms.

9User-Generated Content (UGC)

The Service includes user-generated content surfaces: messages between users, blog comments, broker profile bios, listing descriptions, and testimonials. You are solely responsible for the content you post.

We may — but are not obligated to — review, moderate, or remove UGC at our discretion if it violates these Terms or applicable law. To report content, email support@scoutlify.com or use the in-product report flow where available.

10Intellectual Property

The Scoutlify name, logo, software, interface, and underlying intellectual property are owned by us or our licensors. Except for the limited license to use the Service granted to you in these Terms, no other rights are transferred. You may not copy, reverse-engineer, or build a competing product using our IP.

11Privacy

Our handling of personal data is governed by our Privacy Policy. By using the Service you acknowledge that we collect, use, and share data as described there.

12Termination & Suspension

You may delete your account at any time from Account → Security. We may suspend or terminate your account if you violate these Terms, if your payment becomes overdue, or if we are legally required to do so.

On termination:

• Your published listings are removed from public search.
• Your message history is retained for the other side of any conversation, anonymized to a deleted-user placeholder.
• You remain liable for any charges incurred before termination.

13Disclaimers

The Service is provided “as is” and “as available”. We do not warrant that:

• Listings are accurate, complete, current, or available.
• Any broker is licensed, competent, or honest — although we make a reasonable effort to verify credentials.
• The Service will be uninterrupted, secure, or error-free.

You acknowledge that real-estate decisions are major financial decisions. Scoutlify does not give legal, financial, or tax advice. Always consult licensed professionals and conduct your own due diligence — including in-person inspection, document verification with the Registry of Deeds, and confirmation of the broker's PRC license.

14Limitation of Liability

To the maximum extent permitted by law, Scoutlify and its affiliates, employees, and agents are not liable for any:

• Indirect, incidental, consequential, or punitive damages.
• Loss of profits, business opportunities, data, or goodwill.
• Losses arising from your reliance on a listing, broker, or message.
• Losses caused by service interruptions outside our reasonable control.

Our total aggregate liability to you for any claim relating to the Service is limited to the amount you paid us in the 12 months preceding the claim, or PHP 5,000, whichever is greater.

15Indemnification

You agree to indemnify and hold harmless Scoutlify from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of (a) content you posted, (b) your violation of these Terms, (c) your violation of any third-party right, or (d) any transaction you entered into with another user.

16Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of the Philippines. Any dispute that cannot be resolved amicably will be submitted to the exclusive jurisdiction of the courts of Manila.

Consumers retain any non-waivable rights under Philippine consumer-protection law (Republic Act No. 7394) regardless of this section.

17Changes to These Terms

We may update these Terms from time to time. When we do, we'll update the “Last revised” date at the top of this page. Material changes (those that materially affect your rights or obligations) will also be emailed to active subscribers and posted in the app at least 14 days before they take effect.

Your continued use of the Service after a change takes effect is your acceptance of the new Terms. If you don't agree, you may cancel and delete your account before the effective date.
